Badruddin Ajmal-led All India United Democratic Front (AIUDF) has decided to move the Supreme Court to challenge the judgment given by the Gauhati High Court whereby the high court upheld the Assam government’s steps to convert madrassas in the state into regular schools.
The court had upheld the act passed by the Assam legislative assembly in 2020 to repeal Madrassa Education Procincialisation Acts and also upheld all other notifications to convert 397 provincialised madrassas to general educational institutions.
AIUDF MLA and party general secretary Aminul Islam said that his party has decided to move the Supreme Court over the recent judgment given by the Gauhati High Court upholding the Assam Repealing Bill, 2020.
“When the state government had passed the bill in 2020, our party had opposed it. Madrasa education is not only religious, but mathematics, science, social studies and other common subjects are also there. But they totally violated the Articles 14, 15, 21, 25, 26, 29, 30 of the Indian constitution and this notification has violated several articles. How the high court upheld the decision of the state government… the lands where the madrasas were established are not government land. The lands were given on donation to the government and the schools were worked under venture in past times. Public properties are also in the madrasas and public contributions are also there, Waqf lands are also there,” Aminul Islam said.
He further said that, his party (AIUDF) has no other option than to knock the Supreme Court.
“Our party has decided to move the Supreme Court to seek justice, to save our constitution,” Aminul Islam said.
On February 4, a division bench of the Gauhati High Court dismissed the writ petition filed by 13 petitioners to challenge the act and upheld the act of 2020 passed by the Assam Legislative Assembly to repeal Madrassa Education Procincialisation Acts.
The Assam assembly in December, 2020 had passed the Assam Repealing Bill, 2020 which seeks to abolish the Assam Madrassa Education (Provincialization) Act, 1995 and the Assam Madrassa Education (Provincialization of Services of Employees and Re-Organisation of Madrassa Educational Institutions) Act, 2018.
