HC serves notice to Tripura govt for non-compliance of order
A division of Tripura High Court issued notices to principal secretary and director of education on June 25 after hearing a petition seeking directions to initiate contempt proceeding against them for flouting court order.
The bench comprising Chief Justice Sanjay Karol and Justice Subhashis Talapatra took an exception to the education department for not abiding by the direction of the high court which was passed on January 21 this year.
The same bench had directed the state government to provide service benefits to TET qualified teachers among 10,323 in three months whose service were terminated in 2014 and subsequently upheld by the apex court.
The court observed that the petitioners were selected again on the post of teacher through TET and were appointed on acceptance of their technical resignation and each of them joined before December 31, 2017. However, they had been treated to be a fresh appointee despite a division bench of the high court while cancelling the job of 10,323 teachers had protected their previous service for the purpose of seniority, pension and other benefits.
The judgment had made it clear if the persons who were selected in the previous selection are again selected then the service rendered by them earlier should be counted for the purpose of seniority, pension and all other purposes. The petitioners were entitled for protecting of their past service on subsequent selection in the same post in terms of the judgment for all practical purposes.
However, the state government did not comply with the direction of the high court.
